This Bidder Registration Agreement ("Agreement") is entered into between the undersigned Bidder and the Atlantic City Car Show & Auction ("Auction Company") as a condition of participating in the auction held at the Atlantic City Convention Center on June 11–13, 2026.
By signing below, Bidder agrees to the following terms and conditions:
- Registration Requirements: All bidders must complete this registration form in full, present valid government-issued photo identification, and submit a $10,000 refundable deposit. The deposit will be held as security for purchases made by the Bidder and refunded after the auction if no purchases are made or all obligations are fulfilled.
- Bid Limitations: Bidder agrees to bid only on vehicles they have the financial means to purchase. The Auction Company reserves the right to verify financial capability and void any bids that exceed the bidder's demonstrated ability to pay.
- Bidder Registration Fee: A flat, non-refundable registration fee is required to obtain a bidder number and participate in the auction. This fee must be paid at the time of registration and grants access to the auction event.
- Buyer's Premium: A buyer's premium will be added to the final bid price of each vehicle purchased, calculated as follows:
- 8% on the first $50,000 of the final hammer price
- 5% on the portion of the hammer price exceeding $50,000
- 10% on all Memorabilia and Motorcycles regardless of price
This premium is in addition to the hammer price and must be paid in full at the time of settlement.
- Transfer of Ownership and Liability: Ownership and all risk of loss or damage to a purchased vehicle transfers to the Bidder at the fall of the auctioneer's gavel. The Bidder assumes full responsibility for the vehicle at that time, without exception.
- Payment Terms: Full payment for all purchases is due immediately upon conclusion of the auction. Acceptable forms of payment include wire transfer, certified check, or other guaranteed funds approved by the Auction Company. The $10,000 deposit will be applied toward the purchase if applicable. No titles or vehicles will be released until all funds have cleared. Any stop-payment order or returned check due to insufficient funds shall be considered prima facie evidence of fraud and treated as an intent to defraud.
- Title and Vehicle Release: The Auction Company does not hold a dealer's license and does not issue temporary tags or offer registration services. Title transfers are solely the responsibility of the buyer after completion of payment. All vehicles must be removed from the Atlantic City Convention Center by the close of business on Monday, June 15, 2026. Vehicles not removed by the deadline may be moved and stored at the buyer's expense.
- Bidding Conduct: All bids are per lot unless otherwise stated. Bids placed are binding. In all cases of disputed bids, the auctioneer will determine the highest bidder or may re-offer the vehicle. The auctioneer's decision shall be final. The Auction Company reserves the right to revoke bidding privileges or remove any bidder from the premises for misconduct.
- Inspection and Due Diligence: All vehicles are sold AS IS, WHERE IS, with all faults and no warranty expressed or implied by the Auction Company. The final auction presentation of the vehicle supersedes any prior descriptions. The Bidder is solely responsible for inspecting and verifying the condition, mileage, VIN, and title status of any vehicle prior to bidding.
- Default and Remedies: If the Bidder fails to complete payment, the Auction Company may declare the sale void, re-offer the vehicle, retain the $10,000 deposit and registration fees, pursue legal action, and/or ban the bidder from future events. The Auction Company's records will be final and conclusive in all disputes.
- Indemnification: Bidder agrees to indemnify and hold harmless the Auction Company, its employees, contractors, and affiliates from any liability or loss arising from participation in the auction or purchase of any vehicle.
- Governing Law and Enforcement: This Agreement shall be governed by and construed under the Uniform Commercial Code (UCC) and laws of the State of New Jersey. The Auction Company shall be entitled to recover reasonable attorney's fees and costs incurred in enforcing the terms of this Agreement.
- Entire Agreement: This document constitutes the full agreement between the Auction Company and the Bidder. No oral modifications or representations are valid. Any changes must be in writing and signed by both parties.
